The Legal Affairs Directorate (General Counsel), is the legal arm of the Rwanda Utilities Regulatory Agency. It is in this regard that Legal Affairs Directorate deals not only with the corporate legal matters but also with the legal issues related to the regulated public utilities sectors. The Legal Affairs Department of the RURA serves as the chief legal advisor to the Regulatory Agency and to its various departments. The Legal Affairs Department has to provide legal advice and counsel to the Board and to the Management of RURA. It represents the Managing Director in all enforcement actions and, when needed, coordinates with other national institutions having the enforcement in their attributions in order to enforce RURA’s enforcement actions. The department also plays an important role in handling appeals and conflicts before the Board decides, and where an action of RURA results generate a litigation, the department works closely with the Ministry of Justice, especially with the states attorneys handling the case. The department also manages the day-to-day legal affairs of RURA, providing counsel and legal support to each sector. The department plays an important role in drafting and reviewing regulatory legal framework and licensing, board decisions, and management of contracts. The department provides also advisory opinions on the appropriate legal issue addressed to RURA. The department also oversees the Board and the Management’s compliance with the existing legislation. |
